Mediation Procedures

Since April 1st, 2007 the Zurich Chamber of Commerce together with the Chambers of Commerce of Basel, Bern, Geneva, Neuchâtel, Ticino and Vaud* offers mediation procedures as a tool for resolving commercial conflicts. Mediation is a procedure with which disputes can be resolved in mutual agreement. Two or more parties ask a third person, the mediator, to help them come to an agreement, in order to put aside their dispute or prevent future conflicts. The mediator is neutral with regard to the cause of the dispute and independent from the involved parties. During the course of the mediation the mediator facilitates the exchange of opinions and encourages the parties to explore solutions that are acceptable to all sides. Contrary to an expert, the mediator does not offer his or her own views nor makes proposals like a conciliator, and unlike an arbitrator in an arbitration case, he or she does not render an award.
